Medicom Technologies, Inc. provides services available at our website www.medicom.us (the “Site”). Use of the Site and our services, including any service, software, application, plug-in, mobile application, component, functionality or program provided now or in the future (“Service” or “Services”) is governed by these Terms of Service (“Terms”). These Terms apply to Customer (also referred to as “You”), Customer’s employees (“Employee Users”) and third-party users (“Third Party Users”) (collectively“Users”) utilizing Customer’s Account (as hereinafter defined).
BY COMPLETING THE REGISTRATION PROCESS, YOU REPRESENT AND WARRANT THAT YOU: (i) ARE 18 YEARS OF AGE OR OLDER; (ii) HAVE THE AUTHORITY TO, OR ARE AUTHORIZED TO BIND CUSTOMER TO THESE TERMS AND CONDITIONS; AND (iii) HAVE READ, UNDERSTOOD AND AGREE ON BEHALF OF CUSTOMER TO BE BOUND BY THESE TERMS AND CONDITIONS AND THE PRIVACY POLICY.
Description of Service
The “Service” means the products, platforms, and features provided by Medicom that facilitate the secure exchange, access, and management of medical information. These Services may be accessed online through Medicom’s website, designated portals, or other authorized digital platforms, and may include associated offline components.
Acceptable use Policy
Unacceptable Use. Medicom Technologies, Inc. (“Medicom”) requires that all Customers and other Users of the Service conduct themselves with respect for others. In particular, observe the following rules in your use of the Service:
- Abusive Behavior: Do not harass, threaten, or defame any person or entity. Do not contact any person who has requested no further contact. Do not use ethnic or religious slurs against any person or group.
- Privacy: Do not violate the privacy rights of any person. Do not collect or disclose any personal address, social security number, or other personally identifiable information without each holder’s written permission. Do not cooperate in or facilitate identity theft.
- Intellectual Property: Do not infringe upon the copyrights, trademarks, trade secrets, or other intellectual property rights of any person or entity. Do not reproduce, publish, or disseminate software, audio recordings, video recordings, photographs, articles, or other works of authorship without the written permission of the copyright holder.
- Hacking, Viruses, & Network Attacks: Do not access any computer or communications system without authorization, including the computers used to provide the Service. Do not attempt to penetrate or disable any security system. Do not intentionally distribute a computer virus, launch a denial of service attack, or in any other way attempt to interfere with the functioning of any computer, communications system, or website. Do not attempt to access or otherwise interfere with the accounts of other users of the Service.
- Spam: Do not send bulk unsolicited e-mails (“Spam”) or sell or market any product or service advertised by or connected with Spam. Do not facilitate or cooperate in the dissemination of Spam in any way. Do not violate the CAN-Spam Act of 2003.
- Fraud: Do not issue fraudulent offers to sell or buy products, services, or investments. Do not mislead anyone about the details or nature of a commercial transaction. Do not commit fraud in any other way.
- Web Scraping & Screen Scraping: Do not copy, modify, distribute, transmit, display, reproduce, publish, create derivative works from, link to or frame on another website, use on any other website, or transfer or sell the Site or any of its content. You are prohibited from using the content for any public or commercial purpose. You may not reverse engineer, disassemble, decompile, or otherwise attempt to derive source code from the Site or its content.
- Violations of Law: Do not violate any law.
Consequences of Violation. Violation of this Acceptable Use Policy (this “AUP”) may lead to suspension or termination of the user’s account or legal action. In addition, the user may be required to pay for the costs of investigation and remedial action related to AUP violations. Medicom reserves the right to take any other remedial action it sees fit.
Reporting Unacceptable Use. Medicom requests that anyone with information about a violation of this AUP report it via e-mail to the following address: mbenitz@medicom.us. Please provide the date and time (with time zone) of the violation and any identifying information regarding the violator, including e-mail or IP (Internet Protocol) address if available, as well as details of the violation.
Revision of AUP. Medicom may change this AUP at any time by posting a new version on this page and sending the user written notice thereof. The new version will become effective on the date of such notice.
Privacy. Use of the Site is governed by our Privacy Policy.
Copyright Notice/DMCA Policy
This policy statement lists our requirements for notice of copyright infringement and for responses to such a notice if you or your materials are accused.
We use the copyright infringement procedures of the Digital Millennium Copyright Act.
Notice of Copyright Infringement. To notify us of copyright infringement, please send a written communication to our Copyright Notices Department, at the contact points listed below in Part C. That written communication should include the following:\
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Counter-Notice by Accused Subscriber. If you are a subscriber and we have taken down your materials due to suspicion of copyright infringement, you may dispute the alleged infringement by sending a written communication to our Copyright Notice Department, at the contact points listed in Part C below. That written communication should include the following:
- A physical or electronic signature of the subscriber.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
- The subscriber’s name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which such add ress is located, or if the subscriber’s address is outside of the United States, the Federal District Court for the Eastern District of North Carolina, and that the subscriber will accept service of process from the person who provided notification of copyright infringement or an agent of such person.
Agent for Notices. Please send all notices required by this policy to our Copyright Notice Department at Medicom Technologies, Inc., 555 Fayetteville Street Suite 300, Raleigh, NC 27601,919-390-3014, mbenitz@medicom.us.
Termination of Repeat Infringers. In appropriate circumstances, we will terminate the accounts of subscribers who are repeat copyright infringers.
Revision of Policy. We may revise this policy at any time, including by posting a new version at this website.
